California’s Meal Break Petition and Wyoming’s Wind Warnings

The Federal Motor Carrier Safety Administration (FMCSA) is reviewing a petition from California seeking a waiver from the federal preemption of the state’s Meal and Rest Break (MRB) rules. California Attorney General Rob Bonta and Labor Commissioner Lilia García-Brower have filed this petition to enforce meal and rest break requirements for truck and bus drivers in the state.

Federal regulations currently allow truck drivers to drive for eight hours without a break, but California law requires 30-minute meal breaks every five hours and 10-minute rest breaks every four hours. The FMCSA had previously declared these rules unenforceable under the Trump Administration, but if the waiver is granted, California could enforce its own regulations, emphasizing the importance of breaks to prevent fatigued driving.

Wyoming's High Wind Warning and Road Closures

The Wyoming Department of Transportation has issued a high wind warning, forecasting crosswinds over 55 mph in parts of the state. This poses an extreme blow-over risk, especially for enclosed trailers under 40,000 pounds GVWR. The warning includes expected closures on various highways, including sections of I-80 and I-25, to protect against the risk of vehicle overturns.

Indiana's HOS Relief for Propane Haulers

Governor Eric Holcomb of Indiana has temporarily suspended hours-of-service (HOS) regulations for propane haulers in the state. Due to current supply shortages and transportation challenges, this suspension until December 4 aims to ensure adequate propane distribution throughout Indiana.

Reiman Corp's Special HOS Exemption Request

The FMCSA is also considering a request from Reiman Corp. for a HOS exemption. Reiman Corp specializes in transporting latex embedded cement for highway construction and seeks to have waiting time at construction sites recorded as “off-duty,” similar to exemptions provided for oilfield operations.

These transportation updates reflect the dynamic nature of regulatory considerations in the trucking industry, balancing safety, supply needs, and operational efficiency. As FMCSA reviews these petitions and requests, the outcomes will significantly impact commercial driving regulations and practices.
